Audit Duprey Fekl secures a win for its clients in set-aside proceedings before the Paris Court of Appeal

Audit Duprey Fekl is pleased to report that it has secured a win for its clients in set aside proceedings initiated by an Albanian State-entity before the Paris Court of Appeal. 

To our knowledge, this is the first time that the Paris Court of Appeal ruled that a party’s failure to submit a dispute to a Dispute Board provided for in FIDIC contracts raises an issue of admissibility and does not deprive the arbitral tribunal of its jurisdiction to hear the dispute.
