Partner Mathias Audit, who also serves as a Professor at Université Paris 1 Panthéon-Sorbonne, authored an article titled “La compétence arbitrale ratione temporis dans les litiges d’investissement continus”, a case note on Cassation court, 1st ch., 9 October 2024. Mathias offers insightful analysis of the French Supreme Court’s evolving case law on the arbitral tribunal’s jurisdiction ratione temporis in investment disputes.

Partner Pierre Duprey, together with Senior Associate Daria Astakhova, co-authored an article titled “Le respect du recours au Dispute Board préalablement à l’arbitrage : une question de recevabilité de la demande d’arbitrage en dehors du périmètre du contrôle du juge de l’annulation”, a case note on the Paris Court of Appeal, 4 June 2024. Pierre and Daria examine the French courts’ approach to arbitral jurisdiction, exploring the distinction between issues of admissibility and jurisdiction in the context of annulment proceedings before French courts.
